The attorneys in the Land Use Group of the Litigation department are familiar with all phases of environmental issues, from due diligence before acquisition or development of a property through securing all permits for development, and any appeals resulting from adverse agency decisions. A working knowledge of this process is vital to the success of a land use project. Identifying issues early is key to maintaining a project on schedule and on budget.

The Land Use department has experience in dealing with National Pollution Discharge Elimination System [NPDES] permits, which, as the name implies, is a federal program. The pace of regulation under NPDES has increased and knowledge of the permitting process and its pitfalls is needed for most land use approval projects.

Some issues require an appeal or application to the Environmental Hearing Board. The Land Use department is familiar with the processes and procedures of this Board and has had experience appearing before it both on behalf of the appellant and defending a land use project from a third-party appeal.

The Land Use department lawyers each have significant experience in the environmental arena. One has been named a Top Lawyer by Main Line Today in environmental law and has substantial experience representing businesses and individuals in Superfund, Clean Water Act, Clean Streams Law and other water and ground pollution lawsuits.  All have experience dealing with DEP and other regulatory agencies that function in the application and enforcement of environmental laws. Members of the litigation group involved in environmental litigation have decades of experience in preparing, presenting and defending environmental issues in a variety of forums.
