When an individual falls victim to a serious health condition or disabling injury, he or she may qualify for Social Security Disability benefits. Often however, individuals who suffer from such health conditions or injuries are denied benefits. Denials may occur for a variety of reasons, such as insufficient medical evidence of the claimant's condition. Social Security representatives attempt to secure medical documentation from a claimant's treating physicians. More often than not, the Administration does not have all the claimant's pertinent medical records in its file so as to make a proper disability determination. At other times, claimants are denied benefits because their physical or mental impairments do not fall under one of Social Security's Listed Impairments for Entitlement. When disability claims are denied, MacElree Harvey's experienced disability team steps in to help clients appeal their denial of benefits so that their claim can be properly determined at a hearing before an Administrative Law Judge. Because each individual's medical condition is different, determination of a claim for disability benefits must be done on a case-by-case basis. Our attorneys evaluate each disability case to ensure that the Social Security Administration receives evidence particular to each client's individual medical condition. In addition, our attorneys are experienced in locating and interpreting the intricate regulations promulgated under the Federal Social Security Act, as well as the Act's related laws, which are then analyzed in preparation for a hearing before an Administrative Law Judge. Our attorneys and paralegals also work directly with our clients' physicians and other health care providers to obtain complete copies of all the medical records, reports, diagnostic studies, and evaluations that the Administrative Law Judge will need to render an informed decision. Finally, our disability attorneys attend the hearings with our clients to assist them in presenting the best possible case to the Administrative Law Judge. |
