Judge Lou Mincarelli served as a respected Common Pleas Judge in West Chester, Pennsylvania, both before and after joining MacElree Harvey, and returned to the firm following his most recent judicial service through 2025. He originally joined MacElree Harvey in January of 2024.

Joining MacElree Harvey’s Litigation Department, Judge Mincarelli focuses his practice on criminal, family, commercial litigation, as well as the firm’s mediation and arbitration practice. His diverse legal skill set was shaped by decades of experience as a practicing attorney and years on the bench, where he presided over complex matters across Civil, Criminal, Family, and Juvenile Court.

While serving as a Judge, Judge Mincarelli presided over numerous jury and bench trials in both civil and criminal court and successfully handled dozens of settlement conferences. His experience facilitating resolutions spans both his judicial service and private practice, giving him a practical, balanced perspective on litigation strategy and alternative dispute resolution.

Judge Mincarelli is a certified Civil Mediator, having received his certification from the National Judicial College in 2024. His mediation experience, combined with his extensive trial background, allows him to guide parties toward efficient, informed, and durable resolutions, whether through litigation, mediation, or arbitration.

Judge Mincarelli was nominated by then-Governor Tom Wolf and confirmed by the Pennsylvania Senate to fill a vacancy on the Chester County Court of Common Pleas. He was later reappointed by Governor Josh Shapiro and again confirmed by the Pennsylvania Senate, continuing his judicial service through 2025.

Earlier in his career, Judge Mincarelli served as a Victim Advocate in the Philadelphia District Attorney’s Office, where he gained first-hand insight into the impact of crime on victims and their families. After graduating from Temple University Beasley School of Law, he became a prosecutor in the Philadelphia District Attorney’s Office under former District Attorney Lynne Abraham.

Dan uses his nearly 30 years of experience to assist families and businesses with an assortment of legal matters. He represents clients in a range of estate and trust matters, including preparing wills, trusts, powers of attorney, and creating legal entities in order to plan for family wealth transfers and business successions. He also serves as counsel for numerous local businesses, including startups, established family companies, and large regional operations. Dan regularly assists clients with diverse real estate matters ranging from simple refinances to multimillion dollar purchases, and a variety of business matters from basic contracts and business formations to complex transactions. Because of his experience successfully resolving business issues for his own clients, Dan has been hired as a mediator by third parties as an alternative to litigating in court. He has also served as the court-appointed trustee in several fiduciary litigation cases appearing before the Delaware Court of Chancery, where he also regularly serves as the court-appointed attorney ad litem in guardianship cases.

Prior to joining MacElree Harvey, Dan most recently served as a founding member and managing partner of Crossland, Heinle & Bryde. Born and raised in Delaware, Dan attended the Tatnall School and the University of Rochester prior to graduating from the Villanova University School of Law.

In his spare time Dan enjoys traveling, listening to music, and spending time with friends and family. On fall weekends he can be found cheering on the Pittsburgh Steelers and the Penn State Nittany Lions.

Notable Representations

Represented corporate sellers in the $25 million transfer of three operating car dealerships and two commercial properties, with partial seller financing.
Developed a wealth transfer plan to carry out a client’s philanthropic goals including a charitable remainder trust that successfully provided for the grantor and his wife before providing substantial bequests to several well-known charities.
Helped a client with the purchase of a sizable industrial property, from negotiating the deal and navigating multiple state-imposed environmental restrictions, through settlement and construction of a warehouse on the property.
Negotiated and documented the real estate, business and franchise transfer terms involved in the sale of a client’s business, which included three fast food restaurants and two commercial properties.
Assisted in the design and creation of a complex wealth transfer plan, including family limited liability companies and generation skipping trusts, to enable the transfer of a family real estate compound and multiple commercial properties valued at over $20,000,000 to succeeding generations.
Successfully counseled a business client through the legal process and the lender’s requirements to obtain $12,500,000 in SBA and other financing enabling them to develop an entertainment facility.
Structured the transition of a series of family-owned companies to the next generation through a gifting plan, including the use of valuation discounts, effectuating a substantial estate tax savings.
Defended a commercial condominium association against a Writ of Monition, thereby preventing the commercial condominium building from being subject to a lien and possible sheriff’s sale.
Counsels families and individuals in estate probate and trust administration matters including: the preparation of wills, trusts, powers of attorney, and advance health directives; retitling assets into trust; probating estates; and planning for generational transfers.
Acts as outside legal counsel for local and regional businesses, assisting them in matters including: business startup considerations such as incorporation, licensing and financing; contract drafting, negotiation and review; documenting ownership transfers and financial transactions; preparing statutorily required corporate documentation; and business continuation planning.
Assists clients with commercial and residential real estate issues such as: purchases and sales; refinances; lease drafting and review; creating easements; intrafamily property transfers; and preparing deeds, mortgages, and deed restrictions.

John practices in the areas of Estate Planning and Administration and also co-chairs the firm’s Pennsylvania Mediation and Arbitration Group, along with past Chester County Court of Common Pleas Judge Louis Mincarelli. John has mediated and arbitrated over one hundred matters in his thirty-seven-year career. These matters include estate and trust matters, complex guardianships, real estate disputes, consumer protection, will contests, trust termination and modifications, corporate disputes, contract interpretation and broker liability litigation.

John has also been appointed a Special Master by the Court to hear discovery issues and partition matters. John has also been appointed by the Court to be a receiver for some corporations, as well as an Administrator of Estates involved in litigation. John has a AV Preeminent Rating in Martindale – Hubbell Peer Review Ratings, the highest legal ability, and ethical standards rating. John has been constantly selected to the Main Line Today Top Lawyers lists. Successfully mediated a dispute between the litigants in an estate matter involving several million dollars in property and assets.
Successful in obtaining a guardian for a retired gentleman who had over $4,000,000 in assets.
Successfully replaced a corporate trustee for a church whose Elders were seeking substation due to questionable financial dealings by the initial corporate trustee.
Obtained a judgement for reimbursement of attorneys’ fees and treble damages for a victim of broker fraud, unfair trade practices and unsuitable investments.

Marie I. Crossley has practiced exclusively in the Delaware Family Law arena for over 20 years. She handles a wide variety of Divorce, Custody, Child Support, Alimony and other Family Law matters ranging from the mediation of small disputes to complex Divorce, Custody and Support litigation.

Marie has recently added Mediation to her practice to accommodate clients who are looking for an alternative to the adversarial nature of traditional Divorce, Custody and Support litigation. Marie works out of the Centreville, Delaware office at MacElree Harvey, Ltd.

Marie graduated from Villanova University School of Law in 2001. She clerked for the Honorable Alison Whitmer Tumas and the Honorable William L. Chapman of the Delaware Family Court until entering private practice in 2002. Marie spent ten years as a Family Law Attorney, and then Partner, of a Wilmington Delaware Law Firm until joining the Family Law Group at MacElree Harvey, Ltd.

Marie prefers to be directly involved in every aspect of her client’s matter and feels that communication is the foundation of any successful attorney-client relationship. She works with each client directly providing legal advice and guidance tailored to their specific case.

Successfully assisted a Wife in obtaining a lifetime alimony award against a Husband who refused to support even despite a previous Court Order.
Assisted a client in obtaining an Order, and then enforcing the Order, to force the sale of the former marital residence, despite the spouse’s absolute refusal to cooperate.
Defended a Mother and two young daughters in a Visitation Petition filed by a Father who is an admitted drug addict. After the trial, the Court Ordered Father to submit to drug-testing and limited Father’s contact to a Visitation Center until Father produces a clean drug screen.
Assisted a Father in mediating an agreement for shared residential placement of his two-year-old son. The case involved the issue of breastfeeding and was focused on how to accommodate the feeding schedule without infringing on Father’s relationship with the child.
Successfully obtained an Order for School Enrollment in an Out-of-State school district for a Parent who relocated from the State of Delaware.
Assisted a Bride-to-be in the drafting and negotiating of a Prenuptial Agreement to protect her significant pre-marital assets.
