Attorneys in our public and project finance practice have worked in government at the state and local levels and understand the economic, policy and legal issues surrounding public projects. Municipal Distress & Recovery

Local governments across Pennsylvania face significant challenges in continuing to provide valuable government services in the face of aging infrastructure, declining tax and revenue bases, reduced state and federal funding, escalating health and employment costs and limited access to working capital.

MacElree Harvey’s Municipal Distress and Recovery team is comprised of lawyers and other professionals that work collectively to take a holistic approach to solving the problems that plague local governments across the Commonwealth. Often, addressing these problems “piece-meal” will only address the symptoms-not the causes-of municipal distress. Our Municipal Distress and Recovery team can serve as a valuable ally to local governments as they take on these challenges.

Our team has experience working closely with the Pennsylvania Department of Community and Economic Development (“DCED”), the state agency charged with administering the Municipalities Financial Recovery Act (“Act 47”). Act 47 outlines the ways in which DCED may assist Pennsylvania municipalities that are experiencing financial difficulties in order to ensure the health, safety and welfare of the citizenry.

We have experience advising clients on developing innovative ways to identify potential revenue streams and can help local governments evaluate public private partnership (P3) opportunities to monetize public assets. Often, these transactions can be structured in a way that allows the municipality to maintain control of the asset. Our Litigation and Bankruptcy attorneys have broad experience in the areas of restructuring, bankruptcy, and complex commercial litigation. We have experience representing debtors, creditors’ committees, and other parties-in-interest in complex bankruptcy cases, and are familiar with the issues surrounding municipal defaults, remedies and work-outs.

Public & Project Finance

MacElree Harvey’s public and project finance practice brings together an interdisciplinary team of attorneys from our Banking and Finance, Business and Corporate, Tax and Real Estate practices to advise on all aspects of financing large institutional and other government-related projects.
