Arbitration

In family law matters, arbitration can be an extremely cost-effective and useful tool to resolve disputes between parties. The arbitration process is similar to a trial, as the two disputing parties present evidence and testimony is given, not only by the parties but by their experts. The parties’ lawyers are also present during this process. The arbitrator is a neutral third-party who will consider all evidence and testimony presented by the parties regarding their dispute. He or she will render a binding decision at the conclusion of this presentation based on the facts of the case and the laws of the State in which the parties’ action is based.

The parties and their attorneys will have the opportunity to meet with the arbitrator before the process begins to review the details, discuss proposed exhibits, witnesses, etc., as well as the anticipated length of time the arbitration might require. Arbitration is generally quicker and less expensive than an actual trial before a judge, although extremely complex matters may be, by their very nature, time-consuming and, therefore, costly. This is a contingency which would be discussed at the time of your initial consult with the arbitrator. Collaborative Law

For parties who have, for the most part, reached an emotional level that enables them to conduct negotiations in a civil fashion, collaborative law is an excellent alternative method of dispute resolution outside of the court system. This process of settling divorce matters is often less time-consuming and more cost-effective. The parties and their respective attorneys meet both separately and together to allow the couples to foster productive solutions to their divorce-related matters, which may include not only division of marital property, but also alimony, alimony pendente lite/spousal support, child support and custody.

Parties engaging in the collaborative law process must comply with certain guidelines, most importantly, that they will waive their right to litigate their divorce except under certain circumstances. The parties will also enter into a good faith agreement that they will provide full disclosure of assets and liabilities, and will provide all necessary financial records. Equitable Distribution

The distribution of marital property – also known as equitable distribution – is one of the most difficult issues in many divorce cases.  Equitable distribution is the process of dividing a couple’s marital assets and marital debts as part of their divorce.  It is important to note that the term “equitable” does not necessarily mean “equal”.  Instead, the equitable distribution process involves the evaluation of a number of factors before a court can determine how to fairly divide the parties’ marital estate.  Often, the division is complex as it might involve dividing and distributing assets such as:

  • Real property;
  • Personal property such as cars, jewelry and artwork;
  • Retirement assets such as 401(k)s, pensions and IRAs;
  • Business interests;
  • Investment and bank accounts; and
  • Stock plans, stock options or restricted stock.

Jurisdictional Disputes

Protection From Abuse

Parties on the receiving end in an abusive relationship—whether it is a relationship with a spouse, significant other, or family member, or if the abuse is perpetrated against a party’s child—do have legal recourse through the court system. This recourse takes the form of filing a Petition for a Protection From Abuse Order.

Once the Petition has been filed, a PFA Order may be signed by the judge, if the matter is founded. This order affords legal protection from domestic violence to victims of both genders, and directs the abuser to discontinue contact with the abused or face grave legal consequences. Filing a petition is only part of the process of removing yourself from the situation. Day-to day planning is necessary, due to changes that may be enforced by the PFA. We at MacElree Harvey are here to advise and represent you in this trying time.

The attorneys at MacElree Harvey are also experienced in representing any party named as a defendant in a Protection From Abuse action, and will provide diligent legal representation if you are in need of defense against an allegation of abuse.
