Equitable Distribution

The distribution of marital property – also known as equitable distribution – is one of the most difficult issues in many divorce cases.  Equitable distribution is the process of dividing a couple’s marital assets and marital debts as part of their divorce.  It is important to note that the term “equitable” does not necessarily mean “equal”.  Instead, the equitable distribution process involves the evaluation of a number of factors before a court can determine how to fairly divide the parties’ marital estate.  Often, the division is complex as it might involve dividing and distributing assets such as:

  • Real property;
  • Personal property such as cars, jewelry and artwork;
  • Retirement assets such as 401(k)s, pensions and IRAs;
  • Business interests;
  • Investment and bank accounts; and
  • Stock plans, stock options or restricted stock.

In complex equitable distribution matters, we frequently partner with well-known experts such as business valuators, forensic accountants and tax specialists to assist us in providing our clients with optimal ways to divide their marital estate with their spouse.

Jurisdictional Disputes

Protection From Abuse

Parties on the receiving end in an abusive relationship—whether it is a relationship with a spouse, significant other, or family member, or if the abuse is perpetrated against a party’s child—do have legal recourse through the court system. This recourse takes the form of filing a Petition for a Protection From Abuse Order.

Once the Petition has been filed, a PFA Order may be signed by the judge, if the matter is founded. This order affords legal protection from domestic violence to victims of both genders, and directs the abuser to discontinue contact with the abused or face grave legal consequences. Filing a petition is only part of the process of removing yourself from the situation. Day-to day planning is necessary, due to changes that may be enforced by the PFA. We at MacElree Harvey are here to advise and represent you in this trying time.

The attorneys at MacElree Harvey are also experienced in representing any party named as a defendant in a Protection From Abuse action, and will provide diligent legal representation if you are in need of defense against an allegation of abuse.

Alimony

Just as money can become a source of stress during a marriage, it also is a main point of contention during a divorce or separation. Managing the disputes a couple may have over alimony and child support is a strong point of The Delaware Family Law Group of MacElree Harvey. We work closely with clients on all alimony-related issues, including Spousal Support, Interim Alimony and Permanent Alimony. Similar to child support actions, we employ the use of expert testimony when necessary to insure that our client is able to maintain a consistent standard of living that they enjoyed during the marriage.

Our attorneys also represent clients in defending alimony claims in order to achieve a just and fair result for all involved parties. We routinely employ vocational evaluators and private investigators to ensure that the party seeking alimony is eligible to receive support and is doing what they can to become self-supporting before seeking income from their former spouse.

Divorce
