Daniel R. Losco brings 38 years of experience in commercial and residential real estate matters, as well as business transactions, wills, trusts and estates.  His clients range from commercial and residential real estate developers, regional lending institutions, condominium associations, local business owners, municipal governments as well as private individuals.

Prior to joining MacElree Harvey, Ltd., Mr. Losco was the founding partner of Losco & Marconi, P.A., a Delaware civic litigation and transactional law firm established in July, 1995.  He served as the City Solicitor for the City of Delaware City from 2000 through 2011 and has served as the current City Solicitor for the City of New Castle, Delaware since 2011.  Mr. Losco was recognized in 2010, 2011 and 2012 as a Five Star Wealth Manager in Delaware Today magazine for his work in estate planning and administration.

A native of Pittsburgh, Mr. Losco received his bachelor’s degree from The Pennsylvania State University in 1980 and is a 1984 graduate of the Delaware Law School of Widener University.  While in law school, Mr. Losco was a two year member of the law review serving on the Board of Editors of the Delaware Journal of Corporate Law.

Representative clients include First Citizens Community Bank, Old Republic Title Insurance Company, Delle Donne & Associates, Cirillo Brothers, True Access Capital Corporation and National Council on Agricultural Life and Labor Research Fund, Inc. (NCALL) as well as various private individuals, local businesses and condominium/community maintenance associations.

Notable Representations

  • Secured land use approvals for a 50,000 sq. ft. “flex space” commercial development in Millsboro, Delaware.
  • Formed a five-unit professional office condominium for a group dentists in the Smyrna, Delaware area.
  • Assisted the City of New Castle in the conversion of its Board of Adjustment to a citizen board and providng legal and ethical training to the initial citizen members.
  • Simultaneously settled commerical loans for over $5 million in bridge loan and permanent financing for a new warehouse development in Newark, Delaware.
  • Successfully negotiated and settled the purchase of multiple properties in the City of Wilmington to establish client’s ownership of an entire city block for redevelopment.
  • Assisted a builder/developer in negotiations to develop a vertical farm in the City of Wilmington.
  • Re-wrote the City of New Castle’s Historic Area Commission ordinance to modernize and streamline land use approvals in the City’s nationally recognized historic zone.
  • Successfully negotiated land development agreements with a national home building company for a 200+ lot development in Kent County, Delaware.
  • Successfully negotiated a long term commercial lease for a regional bank at property located in Greenville, Delaware.
  • Successfully defended allegations of financial wrongdoing against a community maintenance association with the Delaware Delaware Common Interest Ownership Act Ombudsman.
  • Completed negotiations and settlement on the purchase of a “Postal Connections” franchise including settlement of an SBA loan and negotiation of a lease assignment.
  • Assisted a terminally ill client with expedited estate planning documentation.

Carolina focuses her practice on Estate Planning and Administration.  She has almost 15 years of experience designing and implementing estate plans for clients from a wide range of financial backgrounds and often works with several generations of the same family. With the assistance of experienced paralegals, she handles all stages of the administration process.   • Lead trial counsel representing a group of mushroom growers who were alleged to have engaged in an antitrust civil conspiracy to fix mushroom prices provided to Winn-Dixie Stores, Inc. After a three-week trial in the Eastern District of Pennsylvania in which Winn-Dixie was seeking millions, the jury returned a defense verdict that was successfully defended on appeal to the Third Circuit Court of Appeals.
  • Obtained millions on behalf of client in a complex commercial contract dispute in a hotly contested case.
  • Represented business owners in high stakes shareholder disputes resulting in successfully negotiated buyouts.
  • Successfully represented a multi-million dollar privately held corporation in a breach of warranty claim filed against an international manufacturer involving a significant capital investment the corporation made in commercial products that were defective resulting in a substantial settlement recovery.
  • Successfully represented a commercial developer in a multi-million dollar dispute over defects in the design and construction of a new commercial office building resulting in a significant confidential settlement for the developer.
  • Successfully represented a leading national builder of high performance modular commercial structures in a breach of contract action asserted against a general contractor.
  • Served as lead counsel for a multi-million dollar company in an action asserted against a major international reinsurance company for the recovery of insurance as a third party beneficiary, which resulted in a favorable confidential settlement.
  • Successfully represented numerous homebuyers and sellers in disputes over misrepresentations and violations of the Real Estate Settlement Disclosure Law.
  • Successfully represented beneficiary in removal proceedings concerning the executor.

William J. Gallagher has been practicing law and serving the community for over 60 years. His practice focuses on general litigation and estates.

Mr. Gallagher currently serves on the Board of Directors of Legal Aid of Southeastern Pennsylvania and is a past president of the organization. He is also a member of the Chester County Bar Association’s Pro Bono Committee and Pennsylvania Bar Association’s Legal Services to the Public Committee. Additionally, Mr. Gallagher served as Board Chair for the Chester County Community Foundation from 2014 to 2016.

A longtime resident of Kennett Square, Mr. Gallagher has also served as zoning hearing board solicitor for the Kennett Township for over forty years.

A graduate of La Salle University, Mr. Gallagher received his law degree from Villanova University.

Mr. Burke focuses his practice on complex commercial litigation and estate and trust litigation. This includes trial and appellate work in federal, state and international courts.   • Representation of foreign government regarding protection of assets in United States and over 30 foreign jurisdictions.
  • Successful resolution of international dispute relating to distribution of life insurance proceeds in excess of $10 million.
  • Represented major technology firm in the resolution of contentious shareholder litigation.
  • Obtained a verdict in a bench trial for clients in a veil-piercing case. Plaintiff unsuccessfully sought to impose a $7 million judgment on personal assets of business owners.
