Marie I. Crossley has practiced exclusively in the Delaware Family Law arena for over 20 years. She handles a wide variety of Divorce, Custody, Child Support, Alimony and other Family Law matters ranging from the mediation of small disputes to complex Divorce, Custody and Support litigation.

Marie has recently added Mediation to her practice to accommodate clients who are looking for an alternative to the adversarial nature of traditional Divorce, Custody and Support litigation. Marie works out of the Centreville, Delaware office at MacElree Harvey, Ltd.

Marie graduated from Villanova University School of Law in 2001.  She clerked for the Honorable Alison Whitmer Tumas and the Honorable William L. Chapman of the Delaware Family Court until entering private practice in 2002.  Marie spent ten years as a Family Law Attorney, and then Partner, of a Wilmington Delaware Law Firm until joining the Family Law Group at MacElree Harvey, Ltd.

Marie prefers to be directly involved in every aspect of her client’s matter and feels that communication is the foundation of any successful attorney-client relationship.  She works with each client directly providing legal advice and guidance tailored to their specific case.

Notable Representations

  • Successfully assisted a Wife in obtaining a lifetime alimony award against a Husband who refused to support even despite a previous Court Order.
  • Assisted a client in obtaining an Order, and then enforcing the Order, to force the sale of the former marital residence, despite the spouse’s absolute refusal to cooperate.
  • Defended a Mother and two young daughters in a Visitation Petition filed by a Father who is an admitted drug addict.  After the trial, the Court Ordered Father to submit to drug-testing and limited Father’s contact to a Visitation Center until Father produces a clean drug screen.
  • Assisted a Father in mediating an agreement for shared residential placement of his two-year-old son.  The case involved the issue of breastfeeding and was focused on how to accommodate the feeding schedule without infringing on Father’s relationship with the child.
  • Successfully obtained an Order for School Enrollment in an Out-of-State school district for a Parent who relocated from the State of Delaware.
  • Assisted a Bride-to-be in the drafting and negotiating of a Prenuptial Agreement to protect her significant pre-marital assets.

Patrick J. Boyer concentrates his practice on family law. He advocates in various areas including, but not limited to, divorce, property division, alimony, child custody and visitation, child support, and domestic violence. In addition, Patrick assists his clients with issues involving guardianship and third-party visitation. He is licensed in Delaware and Pennsylvania and works out of the firm’s Centreville, Delaware office.

Patrick is a partner in MacElree Harvey’s Family Law Group.   He has extensive experience litigating and resolving all types of family law matters, including divorce, child custody, child support, guardianship, and protection from abuse proceedings. Patrick has been recognized as a “Rising Star” in the area of Family Law by Super Lawyers, and has been recognized by his peers as Top Lawyer for Delaware Family Law in Delaware Today since 2019.

Before joining MacElree Harvey, Patrick was a law clerk to two Judges in the Delaware Family Court. Since joining the firm in 2014, Patrick has practiced exclusively in the area of family law. Patrick was selected by the Delaware Family Court to represent child support obligors facing the prospect of incarceration and parents facing the prospect of termination of parental rights.  He also served as Chair of the Family Law Section of the Delaware State Bar Association and has presented at several continuing legal education seminars for other attorneys.

Patrick is licensed in Delaware and Pennsylvania, and can handle matters in both states. His approach is strategic and practical. He works with his clients to understand their goals and educate the client on the Family Court process, their legal rights and obligations, and the range of possible outcomes for their case. Patrick uses his vast knowledge of family law, procedure, and the Court system to develop and execute a plan to achieve the client’s goals either through a favorable settlement or litigation. Patrick is an accomplished trial lawyer, and possesses superior oral and written advocacy skills. Patrick also has extensive appellate experience in the Delaware Supreme Court, where his advocacy has led to the reversal of several Family Court decisions.

Patrick grew up in Delaware and is a graduate of Salesianum High School, La Salle University, and the Penn State Dickinson School of Law.  He is an avid golfer. Patrick enjoys watching the Phillies, trivia, running, and spending time with his wife, son, and daughter.

Representative Cases

  • Successfully filed a Petition with the Orphans’ Court to modify a Trust so that it could be terminated and the proceeds of the Trust were distributed to adult children when the purpose of the Trust was no longer being met. That purpose of the Trust was to protect the interests of any unborn children at the death of the Settlor. Since there were no such children, the Trust needed to be terminated.
  • Helped a family deal with an incapacitated elder parent by finding a Guardianship protective service agency and a financial institution to act as Guardians of the person and of the estate, respectively. The agency Guardian of the person managed the nursing and activities of daily living needs of the elderly parent, while the financial institution invested and managed the funds.
  • The Pennsylvania Department of Revenue denied a deduction on an estate tax return based on the valuation of a minority shareholder issue. The court upheld a Petition filed by our office challenging the denial of the deduction.
  • A non-profit corporation decided to dissolve and distribute its assets.  A Petition was filed by our office and was successful in obtaining court approval of the schedule of distribution.
  • It was alleged that a Will was forged. Our office filed a Petition challenging said Will and it was established, through an expert, that the signature of the Decedent was traced. The matter successfully settled out of court.
  • An Executor was taking money from an estate. Our office brought an action on behalf of the beneficiaries. The Executor was surcharged and ordered not only to put back the amount that he had taken from the estate but also reimburse the estate for the cost of the fees that were incurred.

Motor vehicle accident
A seven-figure settlement for serious foot injuries following a broadside collision between a vehicle and an SUV that failed to yield while turning left.

Motorcycle accident
In a pick-up truck versus motorcycle accident, our client sustained multiple and serious leg and arm fractures. The claim against the driver recovered his policy limits and, likewise, we obtained policy limits from the client’s underinsurance company. To obtain additional compensation for the client, we pursued a claim against the personal assets of the responsible driver, who ultimately settled and agreed to pay significant personal monies and to have that promise secured by a mortgage on his personal residence.

Medical malpractice
Settlement of a case involving an operating room fire that occurred during surgery to remove a facial mole. The surgeon and anesthesiologist failed to communicate about giving the patient oxygen and using an electric cautery tool in combination.  Claim for damages involving first and second-degree facial burns. Settled just before trial.

Car-versus-horse collision
Successfully represented a driver injured after her car collided with horses that had escaped from a breeding farm due to the negligent design and maintenance of the farm’s fencing. Recovered compensation for past and future medical bills, lost wages and pain and suffering.

Dangerous products
A construction worker who was seriously injured when a nail gun misfired and shot a 3″ nail into his chest. Legal claims were filed against the nail gun manufacturer alleging that the nail gun was defective and dangerous because it did not have a safety switch. Case settled prior to trial.
