We are pleased to announce that 14 of our attorneys were recognized on the Super Lawyers® and Rising Stars list in 2021.

Each year, the research team at Super Lawyers, a Thomson Reuters rating service and publication, selects outstanding lawyers from more than 70 practice areas through a rigorous, multi‐phase process that includes:

Alzheimer’s Disease: An Epidemic that Requires Sound Planning

As an Elder Law attorney, I often meet with families and loved ones of individuals who have Alzheimer’s Disease, whether they be in the early stages or are in a later stage of the progression of the Disease. Critical decisions need to be made carefully and without delay to ensure the long-term care and well-being of the ill individual.

When an individual has diminished capacity, it is essential that they have in place essential estate planning documents, particularly Healthcare and General Durable Powers of Attorney. These Powers of Attorney will authorize their named Agent(s) to handle their personal and financial affairs throughout the progression of the Disease. When an individual with dementia lacks capacity and has not already executed Powers of Attorney, a costly guardianship proceeding will almost inevitably occur.

Over the years, I have seen more and more clients who are suffering from dementia and Alzheimer’s Disease. Particularly noteworthy is the increasing number of clients with early-onset dementia, whereby an individual begins to show signs of diminishing capacity in their early 40’s or 50’s.

This increased incidence of clients with dementia in my practice is supported by the 2019 facts and figures recently released by the Alzheimer’s Association. Currently, 5.7 million Americans live with Alzheimer’s disease, that number increasing at an alarming rate with a new diagnosis made every 65 seconds.

The Alzheimer’s Association has found that Alzheimer’s Disease and other dementia-related illnesses are costing the county $290 billion per year, even with caregivers providing an estimated 18.5 billion hours of largely uncompensated care.

If you have a loved one who is suffering from or showing signs of dementia, please do not delay in meeting with an Elder Law attorney to ensure that the individual’s Power of Attorney documents is in good order and that their finances have been evaluated in light of their future long term care needs.

Trust Termination

Even when a trust is established with a clear purpose and the best intentions, over time a trust’s original purpose may lose its relevance.  As attorneys, we often create trusts in order to protect a beneficiary from themselves and others.  However, what options are available to a trust beneficiary who is no longer disabled, has matured and is now capable of sound financial decisions, or is no longer facing creditor and liability claims or marital discord.  What options are available to a trustee who has managed a trust well, the trust has served its purpose, but the trust balance is now small and no longer economical to continue?

Beneficiaries and Trustees who find themselves in these and other similar situations may be glad to learn that Pennsylvania law may permit termination of that trust, even before its stated term expires.

When the Grantor (the individual who established the trust) is still living, the trust may be terminated simply by obtaining the written consent of the Grantor and all of the trust beneficiaries.  When the Grantor has passed, the Trustee may terminate the trust upon written notice to and consent of all of the trust beneficiaries.

While termination by consent is often an option, there are situations which will require Court approval, including those where obtaining unanimous consent of the parties to the trust is not possible.

If you are Trustee or beneficiary of a trust, and you find yourself in a situation where that particular trust no longer makes sense, trust termination may be possible.  We can review the trust document, explore the relationship of the parties to the trust (Grantor, Trustee, and beneficiaries) and assess whether trust termination is an option.
